Verordnung über die Einfuhr von landwirtschaftlichen Erzeugnissen (Agrareinfuhrverordnung, AEV)
Änderung vom 23. Oktober 2013
Der Schweizerische Bundesrat verordnet:
I Die Agrareinfuhrverordnung vom 26. Oktober 20111 wird wie folgt geändert:
Art. 4 Zollansätze Die Zollansätze, die vom Generaltarif nach Artikel 1 Absatz 1 des Zolltarifgesetzes vom 9. Oktober 19862 abweichen, sind in den Anhängen 1 und 2 festgelegt.
Art. 5 Abs. 1 und 2
1 Die Zollansätze der Tarifnummern 1701 und 1702 (Anhang 1 Ziff. 18) werden
vom BLW festgelegt. 2 Das BLW überprüft die Zollansätze monatlich und setzt sie so fest, dass die Preise für importierten Zucker, zuzüglich Zollansätze und Garantiefondsbeitrag (Art. 10 Landesversorgungsgesetz vom 8. Okt. 19823; LVG), den Marktpreisen in der Euro- päischen Union entsprechen.
Art. 6 Abs. 1, 2, 5 und 6
1 Der Zollansatz für Getreide des Zollkontingents Nr. 27 mit den Tarifnummern
1001.9921, 1002.9021, 1007.9021, 1008.1021, 1008.2921, 1008.4021, 1008.5021,
1008.6031 und 1008.9023 wird vom BLW festgelegt.
2 Das BLW setzt den Zollansatz auf den 1. Januar, 1. April, 1. Juli und 1. Oktober so fest, dass der Preis für importiertes Getreide zur menschlichen Ernährung, zuzüglich Zollansatz und Garantiefondsbeitrag (Art. 10 LVG4, dem Referenzpreis von
53 Franken je 100 Kilogramm entspricht.
5 Die Zollansätze für Grobgetreide zur menschlichen Ernährung des Zollkontingents Nr. 28 mit den Tarifnummern 1003.9041, 1004.9021 und 1005.9021 werden vom BLW festgelegt. Das BLW überprüft die Zollansätze monatlich und passt sie

gestützt auf die Formel nach Artikel 28 Absatz 1 Buchstabe b an, sobald die Zoll- ansätze der entsprechenden Futtermittel mit Schwellenpreis angepasst werden. 6 Die Zollansätze für verarbeitetes Getreide zur menschlichen Ernährung der Tarif- nummern 1101, 1102, 1103, 1104 und 1107 werden vom BLW festgelegt. Sie wer- den aufgrund der Grenzbelastung auf den entsprechenden Rohstoffen der Zoll- kontingente Nr. 27 und Nr. 28 mittels Ausbeuteziffern berechnet und um einen Zuschlag von maximal 20 Franken je 100 Kilogramm erhöht. Die Zollansätze der Rohstoffe und jene der Verarbeitungsprodukte werden gleichzeitig angepasst.
Art. 7 Schwellenpreissystem Die Schwellenpreise, die Importrichtwerte und die Bandbreite nach Artikel 20 LwG sowie die Tarifnummern der Waren, deren Zollansätze im Schwellenpreissystem festgelegt werden, sind in Anhang 1 Ziffer 14 aufgeführt.
Art. 9 Anpassung der Zollansätze Das BLW überprüft die Zollansätze für landwirtschaftliche Erzeugnisse mit Schwel- lenpreis oder Importrichtwert monatlich und passt sie an die Entwicklung der Preise franko Zollgrenze an.
Art. 55 Abs. 2
2 Die Artikel 36 und 39 gelten bis zum 31. Dezember 2018.

1 Anhang 1 wird gemäss Beilage geändert.
2 Anhang 2 erhält die neue Fassung gemäss Beilage.

III 1 Diese Verordnung tritt unter Vorbehalt der Absätze 2 und 3 am 1. Januar 2014 in Kraft.
2 Die Änderung von Anhang 3 Ziffer 5 gemäss Beilage tritt am 1. Dezember 2013 in
Kraft.

14. Marktordnungen Saatgetreide, Futtermittel, Ölsaaten sowie Waren,
bei deren Verarbeitung Futtermittel anfallen Marktordnungsspezifische Vorschriften sind in den Artikeln 28–33 geregelt. Einfuh- ren aus Freizonen nach dem Reglement vom 22. Dezember 1933 über die Einfuhr der Erzeugnisse der Freizonen in die Schweiz (SR 0.631.256.934.953) unterstehen keiner GEB-Pflicht. Weitere Ausnahmen und spezifische Vorschriften sind in der entsprechenden Spalte vermerkt. Die Zollansätze sind in Anhang 2 aufgeführt.

[14-4] Die Zollansätze werden aufgrund von Standardrezepturen, die in der Verordnung des WBF vom 7. Dezember 1998 über Zollbegünsti- gungen, Ausbeuteziffern und Standardrezepturen (SR 916.112.231) festgelegt sind, berechnet. [14-5] Die Zollansätze von Getreidemischungen zu Futterzwecken werden nach Artikel 28 Absatz 5 festgelegt. [14-6] GEB-pflichtig ab 20 Kilogramm brutto nach den Bestimmungen des LVG (SR 531)
Bandbreite Die Bandbreite beträgt für die in diesem Anhang aufgeführten Schwellenpreise und Importrichtwerte plus/minus 3 Franken je 100 Kilogramm.

15. Marktordnung Getreide und verschiedene Samen und Früchte
zur menschlichen Ernährung Für die Einfuhr der aufgeführten Erzeugnisse ist eine GEB des BLW oder eine GEB nach den Bestimmungen des LVG (SR 531) erforderlich. Einfuhren aus Freizonen nach dem Reglement vom 22. Dezember 1933 über die Einfuhr der Erzeugnisse der Freizonen in die Schweiz (SR 0.631.256.934.953) unterstehen keiner GEB-Pflicht. Weitere Ausnahmen sind in der 3. und 5. Spalte vermerkt. Einfuhren im Reiseverkehr sind in Artikel 45 und 47 sowie in Anhang 5 geregelt. Spezifische Vorschriften: Die Verteilung der Zollkontingente ist in den Artikeln 28–33 und die Festlegung der Zollansätze der betroffenen Tarifnummern in Arti- kel 4 beziehungsweise in Artikel 6 geregelt. Für die Tarifnummern aus dem
12. Kapitel des Zolltarifs bestehen keine spezifischen Vorschriften.
