Art. 1 Campo d’applicazione

Il presente Accordo sul commercio di prodotti agricoli tra tra la Confederazione Svizzera (qui di seguito denominata «Svizzera») e la Repubblica di Albania (qui di seguito denominata «Albania») è concluso facendo seguito all’Accordo di libero scambio tra gli Stati dell’AELS e l’Albania (qui di seguito denominato «Accordo di libero scambio»), firmato il 17 dicembre 2009 2 , in particolare ai sensi dell’articolo 6 paragrafo 2 di tale Accordo.

Il presente Accordo si applica anche al Principato del Liechtenstein fino a quando il Trattato di unione doganale concluso il 29 marzo 1923 3 tra la Svizzera e il Principato del Liechtenstein rimane in vigore.

Art. 2 Concessioni tariffarie

L’Albania accorda concessioni tariffarie per i prodotti agricoli originari della Svizzera specificati nell’Allegato 1. La Svizzera accorda concessioni tariffarie per i prodotti agricoli originari dell’Albania specificati nell’Allegato 2.

Art. 34 Regole di origine e cooperazione amministrativa

I diritti e gli obblighi delle Parti in relazione alle regole d’origine e alla cooperazione amministrativa tra le autorità doganali delle Parti sono disciplinati dal Protocollo B dell’Accordo di libero scambio.

Nel Protocollo B ogni riferimento agli «Stati dell’AELS» va inteso come riferito alla Svizzera .

Art. 4 Dialogo

Le Parti esaminano qualsiasi difficoltà che può insorgere nel commercio reciproco di prodotti agricoli, sforzandosi di trovare soluzioni adeguate.

Art. 5 Ulteriore liberalizzazione

Le Parti si adoperano per promuovere una progressiva liberalizzazione del commercio reciproco di prodotti agricoli, tenendo conto della struttura delle loro relazioni commerciali in questo ambito, delle particolari sensibilità di tali prodotti e dello sviluppo della politica agricola di ciascuna Parte. Su richiesta di qualsiasi Parte, le Parti si consultano al fine di raggiungere tale obiettivo, includendo la possibilità di migliorare l’accesso ai mercati mediante la riduzione o l’eliminazione di dazi su prodotti agricoli e di ampliare la portata dei prodotti agricoli coperti dal presente Accordo.

Art. 6 Accordo dell’OMC sull’agricoltura

Le Parti riaffermano i loro diritti e i loro obblighi derivanti dall’Accordo dell’OMC sull’agricoltura 5 .

Art. 7 Disposizioni dell’Accordo di libero scambio

Le disposizioni sull’applicazione territoriale (art. 3), sul governo centrale, regionale e locale (art. 4), sulle restrizioni all’importazione e all’esportazione (art. 9), sulle misure sanitarie e fitosanitarie (art. 11), sui regolamenti tecnici (art. 12), sulle misure di salvaguardia bilaterali (art. 20), nonché il capitolo 8 6 sulla composizione delle controversie derivanti dall’Accordo di libero scambio si applicano, mutatis muta n dis , tra le Parti al presente Accordo.

Art. 8 Entrata in vigore e relazione tra il presente Accordo e l’Accordo di libero scambio

Il presente Accordo entra in vigore o viene applicato provvisoriamente alla stessa data in cui entra in vigore o viene applicato provvisoriamente l’Accordo di libero scambio tra la Svizzera e l’Albania. Il presente Accordo rimane in vigore fino a quando l’Accordo di libero scambio rimane in vigore tra le suddette Parti.

In fede di che, i sottoscritti, debitamente autorizzati a tale scopo, hanno firmato il presente Accordo.
