Ordinanza che istituisce provvedimenti nei confronti della Repubblica Islamica dell’Iran

Modifica del 23 aprile 2008

Il Consiglio federale svizzero ordina:

I L’ordinanza del 14 febbraio 2007¹ che istituisce provvedimenti nei confronti della Repubblica Islamica dell’Iran è modificata come segue:

Ingresso visto l’articolo 2 della legge del 22 marzo 2002² sugli embarghi (LEmb); in esecuzione delle risoluzioni 1737 (2006), 1747 (2007) e 1803 (2008)3 del Consi- glio di sicurezza delle Nazioni Unite,

Art. 1a Divieto di fornire materiale d’armamento e materiale affine Sono vietati la fornitura, l’importazione, il transito e la mediazione di materiale d’armamento d’ogni genere, comprese armi e munizioni, di veicoli e di equipaggia- mento militari, di attrezzature paramilitari, nonché dei relativi accessori e pezzi di ricambio provenienti dalla Repubblica Islamica dell’Iran.

Art. 3a Divieto di adempimento di determinate richieste È vietato adempiere richieste delle seguenti persone, imprese e organizzazioni se dette richieste hanno un nesso con un contratto o un affare la cui esecuzione è osta- colata o pregiudicata direttamente o indirettamente da misure decise dal Consiglio di sicurezza dell’ONU nell’ambito delle risoluzioni 1737 (2006), 1747 (2007) e 1803 (2008): a. Governo della Repubblica Islamica dell’Iran; b. persone fisiche, imprese e organizzazioni con sede nella Repubblica Islami- ca dell’Iran; c. persone fisiche, imprese e organizzazioni giusta gli allegati 3 e 4; d. persone fisiche, imprese e organizzazioni che operano su incarico o a favore di una persona, impresa od organizzazione citata alle lettere a–c.

Art. 3b Divieto di entrata e di transito 1 L’entrata in Svizzera o il transito attraverso la Svizzera sono vietati alle persone fisiche elencate nell’allegato 4.

2 L’Ufficio federale della migrazione (UFM) può concedere deroghe in conformità

alle decisioni del competente Comitato del Consiglio di sicurezza delle Nazioni Unite.

Art. 4 cpv. 1, 1bis e 3 1 La SECO sorveglia l’esecuzione delle misure coercitive di cui agli articoli 1, 1a, 2 e 3a. Essa notifica al competente Comitato del Consiglio di sicurezza dell’ONU e all’Agenzia internazionale per l’energia atomica la fornitura di beni, compresi le tecnologie e i software, in conformità alle risoluzioni 1737 (2006) e 1803 (2008). 1bis L’UFM sorveglia l’esecuzione del divieto di entrata e di transito di cui all’articolo 3b. 3 L’UFM emana, giusta il capoverso 2, le necessarie istruzioni di esecuzione per gli organi di controllo di confine, per le rappresentanze all’estero e per gli altri uffici che all’estero sono autorizzati a rilasciare i visti.

Art. 6 cpv. 1 1 Chiunque viola gli articoli 1, 1a, 2, 3a o 3b è punito conformemente all’articolo 9 LEmb.

II Gli allegati 1 e 3 sono sostituiti dalle versioni qui annesse.

III La presente ordinanza è completata dal nuovo allegato 4 qui annesso.

IV La presente modifica entra in vigore il 24 aprile 20084.

Allegato 1 (art. 1 cpv. 1)

Beni, compresi tecnologie e software, che incorrono nel divieto giusta l’articolo 1 capoverso 1

1. Beni giusta l’allegato 2 parte 1 OBDI5. Sono esclusi i beni dal numero di

controllo delle esportazioni 0A001, fintantoché essi non sono destinati a reattori ad acqua leggera.

2. Materiali nucleari giusta l’articolo 1 dell’ordinanza 10 dicembre 20046

sull’energia nucleare del (OENu). Fa eccezione l’uranio scarsamente arric- chito in elementi combustibili approntati per reattori ad acqua leggera.

3. Sistemi completi di razzi e aeromobili senza pilota, compresi sottosistemi

completi. 4. Beni giusta l’allegato 2, 2a parte OBDI dal numero di controllo delle espor- tazioni codice 101–199. 5. Beni giusta l’allegato 2, 2a parte OBDI dal numero di controllo delle espor- tazioni codice 201–299. Questi beni fanno eccezione fintantoché sono esclu- sivamente destinati a reattori ad acqua leggera o indispensabili alla coope- razione tecnica che l’Agenzia internazionale per l’energia atomica ha accordato alla Repubblica Islamica dell’Iran. 6. Tutti i beni rimanenti che possono essere impiegati in relazione con sistemi di razzi e con aeromobili senza pilota, giusta il punto 3, e quelli contemplati dall’allegato 2, 2a parte OBDI, dall’allegato 3 OBDI e dall’allegato 1 dell’ordinanza del 25 febbraio 19987 concernente il materiale bellico (OMB).
