Schriftliche Begründung

Sowohl Artikel 264a Absatz 2 (Abweichung vom Mindestalter bei der gemeinschaftlichen Adoption) als auch Artikel 264b Absatz 4 (Abweichung vom Mindestalter bei der Einzeladoption) sehen eine Begründungspflicht der adoptionswilligen Person vor ("Die adoptionswillige Person hat die Abweichung zu begründen."). Der Hinweis auf eine solche Begründungspflicht fehlt dagegen in Artikel 264d (Abweichung vom Altersunterschied zwischen Kind und adoptionswilliger Person). Wie die Redaktionskommission festgestellt hat, stellt dieses Fehlen der Begründungspflicht ein Versehen dar. Eine entsprechende Begründungspflicht ist daher auch in Artikel 264d einzufügen.

Développement par écrit

Tant l'article 264a alinéa 2 (dérogation à la condition de l'âge minimal lors de l'adoption conjointe) que l'article 264b alinéa 4 (dérogation à la condition de l'âge minimal lors de l'adoption par une personne seule) prévoient une obligation pour l'adoptant de motiver la dérogation ("L'adoptant doit motiver la dérogation."). L'article 264d (dérogation à la condition de la différence d'âge entre l'enfant et l'adoptant), par contre, ne prévoit pas de telle obligation. Comme l'a constaté la Commission de rédaction, cette omission constitue une erreur, qu'il s'agit de réparer en complétant l'article 264d par une obligation de motiver une dérogation.
