Résumé

La création d'un sous-sol qui double l'emprise au sol du bâtiment ne peut être qualifiée de transformation partielle (art.24 al.2 LAT). L'autorisation ne pouvant être délivrée au regard de la LAT et de la LALAT, il n'apparaît pas utile de l'examiner sous l'angle de la nouvelle loi sur les forêts. Amende de CHF 30'000.- réduite à CHF 15'000.- et confirmation de l'ordre de démolir le sous-sol.
