Ordinance on Mitigating the Effects of the Coronavirus Pandemic on Leases (COVID-19-Ordinance Leases) of 27 March 2020 (Status as of 28 March 2020) The Swiss Federal Council, on the basis of Article 185 paragraph 3 of the Federal Constitution1, ordains:
Art. 1 Measures related to moving in and out of property
Moving out of and moving into leased residential or business property is permitted subject to compliance with the recommendations issued by the Federal Office of Public Health relating to hygiene and social distancing.
Art. 2 Extension of the deadline in the case of rent arrears due by tenants
If as a result of measures taken by the Federal Council to combat the coronavirus a tenant falls into arrears with the payment of rent or accessory charges that are due for payment between 13 March 2020 and 31 May 2020, in derogation from Article 257d paragraph 1 of the Code of Obligations (CO)2, the deadline set by the landlord for payment of the rent or accessory charges must amount to at least 90 days.
Art. 3 Notice of termination for furnished rooms and parking spaces
In derogation from Article 266e CO3, the period of notice of termination for the lease of furnished rooms and of separately rented parking spaces or similar facilities amounts to 30 days.

Art. 4 Deadline extension in the case of rent arrears due by usufructuary leaseholders
If as a result of measures taken by the Federal Council to combat the coronavirus a usufructuary leaseholder falls into arrears with the payment of rent or accessory charges that are due for payment between 13 March 2020 and 31 May 2020, in derogation from Article 282 paragraph 1 CO4, the deadline set by the landlord for payment of the rent or accessory charges must amount to at least 120 days.
Art. 5 Commencement and duration
This Ordinance comes into force on 28 March 2020 at 00.00
It applies until 31 May 2020.
