Abusive dismissal

Abusive dismissal is a termination given for improper reasons, such as retaliation, protected personal traits or exercising legal rights.

In Switzerland, an employer may usually terminate an open-ended employment contract without cause, but the reason and manner of dismissal must not be abusive. Abusive grounds include retaliation for asserting workplace rights, dismissal because of protected personal characteristics unrelated to the job, or termination designed to prevent claims arising under the contract. Procedural unfairness or humiliating conduct can also matter. The dismissal generally remains effective, but the employee may claim compensation if they object in time and bring the claim within the applicable deadline.
