Acknowledgment of claim

Acknowledgment of claim is the defendant’s acceptance of the claimant’s request, often leading to termination or judgment accordingly.

In Swiss civil proceedings, a defendant may acknowledge the claim wholly or partly. This procedural declaration accepts the claimant’s requested relief and can lead the court to decide or close the case accordingly, without further examination of disputed facts to that extent. The acknowledgment may have important cost consequences; the acknowledging party is often treated as unsuccessful unless circumstances justify another allocation. It differs from a settlement because it is unilateral, and from a mere admission of fact because it concerns the claim or relief itself.
