Appeal against interim decision
An appeal to the Federal Supreme Court against a non-final ruling, admissible only for specified interim matters or strict exceptional grounds.
An appeal against an interim decision seeks immediate Federal Supreme Court review before the lower proceedings are complete. Swiss procedure restricts such appeals to avoid fragmented litigation. Decisions on jurisdiction or recusal are typically treated more readily, while other interim rulings require a showing such as irreparable harm or, in exceptional circumstances, that immediate review could avoid costly and lengthy proceedings. If immediate appeal is unavailable or unused, the party may often challenge the interim ruling later together with the final decision, provided the issue remains relevant.
