Appeal in criminal matters
An appeal in criminal matters seeks review of a criminal judgment by a higher court on facts, law, or sentence within procedural limits.
In Swiss criminal procedure, an appeal is an ordinary remedy against certain first-instance criminal judgments. It allows the appellate court to review contested points, often including factual findings, legal assessment, guilt, sanctions, costs, or civil claims joined to the criminal case. The appellant must observe strict time limits and specify the challenged parts. Depending on the scope of the appeal, the higher court may confirm, amend, set aside, or return the case. Separate remedies exist for some procedural decisions.
