Bankruptcy threat

A bankruptcy threat is the formal warning that a debtor subject to bankruptcy may face a bankruptcy petition if payment is not made.

In Swiss enforcement against debtors subject to bankruptcy, the bankruptcy threat follows the payment order once the creditor is entitled to continue. It warns the debtor that failure to pay may lead the creditor to request the opening of bankruptcy. The document is issued by the debt enforcement office and is a procedural prerequisite before the creditor can file the bankruptcy request. It does not itself open bankruptcy, but it marks the transition from individual collection pressure to possible collective liquidation.
