Building right
A Swiss easement allowing a person to own or erect a building on another’s land, often granted for a long fixed term.
A building right is an independent and permanent easement that separates ownership of a structure from ownership of the land. In Swiss practice it allows the holder to build on or maintain a building on another person’s parcel, usually against periodic ground rent and for a fixed long term. If independent and permanent, it may itself be entered in the land register as a distinct real property unit and mortgaged. The agreement regulates duration, rent, use, maintenance, reversion at expiry, and compensation.
