A choice of forum clause designates the court or tribunal that will hear disputes, often shaping jurisdiction and enforcement in cross-border cases.
A choice of forum clause is a contractual agreement on where disputes must, or may, be brought. In international commerce it reduces uncertainty about jurisdiction and may support recognition of the resulting judgment. Swiss courts generally respect valid jurisdiction agreements, subject to mandatory rules, consumer or employment protections, and international instruments where applicable. The clause should identify the forum clearly, distinguish exclusive from non-exclusive jurisdiction, and align with any arbitration clause or governing-law clause.
