Collocation action

A collocation action allows a creditor in Swiss bankruptcy proceedings to contest the schedule of claims. The action may seek admission of the claimant’s own rejected claim, reduction or exclusion of another creditor’s claim, or correction of ranking. It is directed against the party whose position would be worsened by the change. The action does not generally determine the debtor’s liability beyond the bankruptcy context; its practical purpose is to settle participation in the estate and the creditor’s share in distributions.
