Community of property
Community of property creates common marital property shared by spouses, alongside any individual property reserved by law or agreement.
Community of property is a contractual matrimonial property regime in Swiss family law. Spouses may establish a community covering all or selected assets, while some assets remain individual property by law or by agreement. Community assets are generally managed and liquidated according to the marital agreement and statutory rules, with both spouses participating in the common estate. The regime can affect creditor liability and estate planning, so precise drafting is important. It is less common than participation in acquired property or separation of property but remains available to married couples.
