Complaint in criminal procedure
A complaint is a criminal-procedure remedy against certain decisions or acts of authorities that are not challenged by appeal.
In Swiss criminal procedure, the complaint is an ordinary remedy used to challenge many procedural decisions, omissions, or acts by prosecution authorities, police, compulsory measures authorities, or courts where appeal is not available. It often concerns detention-related orders, search and seizure, evidence issues, refusals to act, costs, or termination decisions, depending on the procedural stage. The complainant must have a legally protected interest and comply with short time limits. The reviewing authority may annul, amend, or instruct the lower authority to act.
