Composition proceedings

In Switzerland, composition proceedings provide a formal framework for a debtor in financial distress to negotiate a restructuring or composition agreement with creditors under judicial supervision. They often begin with a moratorium that protects the debtor while an administrator examines prospects and assets. The arrangement may involve deferral, partial waiver, asset assignment or other restructuring terms. If approved and confirmed, it binds affected creditors according to the applicable rules; if it fails, bankruptcy or ordinary enforcement may follow.
