Conciliation procedure

Conciliation procedure is a usually mandatory pre-court step in Swiss civil matters aimed at settling the dispute before litigation.

In many Swiss civil disputes, proceedings begin before a conciliation authority rather than directly in court. The authority seeks an amicable settlement, may record an enforceable agreement, and in some cases can make a proposal or decide minor matters if the law permits. If settlement fails, the claimant normally receives authorization to proceed, which allows filing the action in court within the applicable time limit. Conciliation is not required for all matters; exceptions depend on the type of dispute and procedural rules.
