Contempt of court

Misconduct that defies or obstructs the authority or functioning of a court, especially by disobeying orders.

Contempt of court is a strong common-law label for conduct that undermines judicial authority, such as breaching injunctions, disrupting hearings, intimidating witnesses, or refusing to comply with court orders. Swiss law does not use the concept in the same broad form, but courts can enforce orders through procedural sanctions, fines, criminal-law mechanisms in specific cases, and compulsory execution. The comparative term is useful in international disputes, especially when foreign orders or disclosure duties are involved. Swiss counsel should translate the issue into the relevant domestic remedies and limits, including due process and proportionality.
