Data retention laws

Data retention concerns metadata such as subscriber information, connection records, location data, or IP allocation data, not usually the content of communications. In Switzerland, retention and access rules intersect with telecommunications surveillance, criminal procedure, data protection, and constitutional privacy guarantees. They raise proportionality issues because retained data can reveal detailed behavioural patterns. Comparative debates focus on blanket versus targeted retention, independent authorisation for access, security safeguards, retention periods, and deletion duties. Providers must manage technical compliance while limiting use to legally permitted purposes.
