Defence counsel
A lawyer or authorised representative who safeguards the accused person’s rights and assists in the conduct of the criminal defence.
Defence counsel advises and represents the accused in criminal proceedings, ensuring that procedural rights are effective. In Switzerland, counsel may attend interrogations, inspect the file when permitted, make submissions and evidence requests, challenge measures, and plead at trial. The accused generally chooses counsel freely, but the law also provides for mandatory or official defence in defined situations. Defence counsel must act loyally for the client within professional and procedural duties and remains independent from the prosecution and court.
