Diminished responsibility

Diminished responsibility does not make the act lawful and does not automatically exclude punishment. In Swiss criminal law, it concerns a substantial reduction in the offender’s ability, at the time of the offence, to understand the wrongfulness of the conduct or to act in accordance with that understanding. The court may reduce the penalty and may also consider measures if a disorder creates risks. The assessment is fact-specific and commonly relies on psychiatric expertise.
