Distance selling
Distance selling involves contracts concluded through remote communication, including websites, apps, telephone, email or catalogues. Legal issues include seller identity, clear pricing, delivery terms, payment security, data protection, electronic contracting, proof of consent and possible withdrawal rights. Swiss law does not mirror the EU distance-selling regime in every respect, so Swiss consumers do not always have an automatic cooling-off right for online purchases. Cross-border sellers must consider both Swiss rules and, where applicable, foreign consumer law and platform obligations.
