A domain name dispute concerns conflicting rights in an internet address, often involving trademarks, trade names or abusive registration.
Domain name disputes arise when a registered domain conflicts with another party’s sign, name or business identifier. In Switzerland, conflicts may be assessed under trademark, company-name, personality and unfair-competition principles, alongside contractual registry rules. Common issues include cybersquatting, likelihood of confusion, bad-faith registration and legitimate interest in the name. Remedies may include transfer, cancellation, injunctions or damages, depending on the forum. For many generic and country-code domains, administrative dispute-resolution procedures offer a faster alternative to court proceedings.
