Encryption law
Encryption law governs the lawful use, regulation and compelled access issues surrounding cryptographic tools that protect data and communications.
In Switzerland, encryption is generally lawful and often forms part of appropriate security for personal data, trade secrets and communications. Legal questions arise when authorities seek access to encrypted material, when regulated sectors set security expectations, or when providers design services with end-to-end encryption. Businesses must balance confidentiality, lawful disclosure duties, record-keeping and incident response. International operations may face export controls, sanctions, foreign lawful-access rules or conflicts between secrecy obligations and disclosure demands. Encryption does not remove duties to manage keys and protect metadata.
