End of legal personality

The end of legal personality occurs at death, after which rights and obligations are settled mainly through succession and estate administration.

For natural persons, legal personality ends with death. From that moment the deceased no longer holds rights and duties as a legal subject; patrimonial positions pass into the estate and are dealt with under succession law. Certain personality-related interests, such as respect for the body, memory and reputation, may still receive legal protection through relatives or specific rules. The time and proof of death are therefore important for inheritance, marital status, insurance, pensions, registration and procedural matters.
