Enforcement proceedings
Enforcement proceedings are formal steps used to compel payment or performance of a claim, typically through Swiss debt enforcement or courts.
Enforcement proceedings translate a legal claim into compulsory measures against a debtor or assets. In Switzerland, monetary claims are usually pursued through debt enforcement offices, with different paths for seizure, bankruptcy or pledge realisation depending on the debtor and claim. Non-monetary obligations normally require court proceedings and specific enforcement measures. Enforcement is procedural and does not always decide the underlying merits; objections, provisional measures and recognition issues may affect the process.
