Enforcement title

An enforcement title is a decision, deed or other legally recognised basis allowing a creditor to obtain compulsory enforcement.

In Swiss practice, compulsory enforcement normally requires a recognised basis showing that the obligation is due and enforceable. Depending on the claim and procedure, this may be a court judgment, arbitral award, settlement, authentic deed, or another instrument accepted by law. In debt collection, the title often serves to remove or overcome the debtor’s objection before continuation. Comparative systems use similar ideas, although terminology and formal requirements vary.
