Glossary / Civil Law General Concepts

Forfeiture

Forfeiture is a broad term for losing a legal entitlement as a consequence of non-compliance, lapse of time or specified conduct. In Swiss private-law contexts it may describe the loss of contractual rights, options, security interests, procedural opportunities or benefits under rules or agreements. It overlaps with peremption when the loss results from missing a strict time limit, but it is not limited to timing. Its validity and effects depend on the legal basis, proportionality concerns, mandatory law and the interpretation of the relevant contract or statute.
