Freedom of expression protects the communication of opinions and information, while allowing proportionate limits for rights and public interests.

Freedom of expression protects the formation, holding and communication of opinions and information through speech, writing, art, media, protest and digital communication. It is central to democracy because public debate, criticism of authorities and participation depend on it. In Switzerland, it interacts closely with media freedom, assembly rights, political rights and direct democracy. The right does not protect every form of conduct without limits: restrictions may address defamation, threats, hate speech, privacy, public order, professional secrecy or fair trial interests. Any restriction must rest on a lawful basis, pursue a legitimate public interest or protect others, and be proportionate. Comparative law differs in how strongly offensive or extremist expression is protected.
