Image rights
Image rights concern the consent-based use of a person’s identity in advertising, merchandising, broadcasting, games, social media, and sponsorship. They overlap with personality rights, privacy, data protection, copyright, trademarks, unfair competition, and contract law. Swiss law protects personality interests and allows commercial licensing, but agreements should define permitted uses, territory, duration, exclusivity, approvals, moral concerns, termination, and revenue. For athletes, performers, and influencers, image-right structures must align with employment, club, federation, sponsor, tax, and platform obligations.
