Immission

Immission describes a physical or similar impact that originates on one property and affects another, such as noise, smoke, smells, vibrations, light, shade, dust, or water. Swiss neighbour law does not prohibit every immission; ordinary and locally acceptable effects may have to be tolerated. Excessive or unlawful immissions can trigger claims for prevention, cessation, removal, or damages, depending on the circumstances. Assessment is fact-specific and considers location, intensity, duration, zoning, prior use, and public-law permits, which do not automatically eliminate private-law liability.
