Investigation

The preliminary phase in which police and prosecutors clarify suspected offences, gather evidence and decide the next procedural step.

In Swiss criminal procedure, investigation forms part of the preliminary proceedings. Police may make initial inquiries, secure traces and question persons, while the prosecutor directs the formal investigation once sufficient suspicion exists. The aim is to establish whether an offence was committed, identify the responsible person, and collect evidence lawfully. The investigation must consider both incriminating and exculpatory facts. It may end with discontinuance, a penalty order, diversionary outcomes where available, or an indictment before a court.
