Legitimate interest

A legitimate interest is a practical, legally relevant stake that may justify participation, access, or standing in administrative matters.

In Swiss administrative procedure, a legitimate interest often determines whether a person may request a decision, inspect files, or bring an appeal. The interest usually must be personal, current, and worthy of protection, not merely abstract curiosity or a general political concern. It can be legal, economic, factual, or ideal in nature, depending on the context. The requirement helps courts and authorities distinguish affected persons from the public at large while preserving access to legal protection where a decision has real consequences.
