Mass dismissal

Swiss law imposes additional duties where an employer intends to dismiss a significant number of employees for reasons unrelated to individual conduct. Depending on the size of the workforce and number of dismissals, the employer must consult employee representatives or employees, provide relevant information, and notify the competent authority. The consultation aims to explore ways to avoid dismissals, limit their number, or mitigate consequences. Failure to comply may affect the validity, timing, or financial consequences of terminations.
