Moral damages

Moral damages are compensation for non-economic injury; in Swiss terminology they largely correspond to satisfaction for serious immaterial harm.

“Moral damages” is a comparative term for compensation of non-pecuniary harm, such as pain, emotional distress, loss of enjoyment or serious personality injury. In Swiss usage, the closest concept is satisfaction, awarded only when the immaterial harm reaches a sufficient seriousness. The award is not punitive and is assessed equitably. Because terminology differs across jurisdictions, moral damages should not be confused with ordinary financial damages, aggravated damages or punitive damages.
