Parental authority

Parental authority is the bundle of rights and duties by which parents care for, represent and make major decisions for their minor child.

In Swiss family law, parental authority covers care, education, legal representation and administration of a child’s property, always guided by the child’s best interests. It is usually exercised jointly by both parents, including after separation or divorce, unless an authority or court orders otherwise. Everyday care may lie mainly with one parent, but major decisions—such as schooling, health matters or residence—often require cooperation. The child’s views should be considered according to age and maturity.
