Party testimony
Party testimony covers procedural questioning or formal examination of a party about disputed facts. In Swiss civil procedure, party statements may serve as evidence, but their weight depends on candour, consistency, detail and support from other evidence. Because a party has a direct stake in the dispute, courts usually assess such statements carefully and compare them with documents, witness testimony and conduct. Depending on the procedure, false statements may have legal consequences. Party testimony is distinct from legal submissions made by counsel.
