Platform liability
Swiss law does not rely on a single comprehensive platform-liability code. Responsibility depends on the platform’s role, knowledge, control over content or transactions, contractual commitments and sector-specific duties. Issues include defamation, intellectual property, consumer protection, illegal products, competition law, data protection and financial or mobility services. Notice-and-takedown practices, moderation terms and transparent procedures reduce risk but must respect users’ rights and evidence needs. Comparative EU rules may matter for Swiss platforms serving EU users or operating through EU establishments.
