Presumption of death

A presumption of death allows the law to treat a missing person as deceased when disappearance and circumstances make death highly probable.

Presumption of death addresses situations where a person has disappeared and no body or direct proof of death is available. Swiss law permits formal procedures to establish death or declare a missing person presumed dead when statutory conditions are met, especially after life-threatening events or prolonged absence. The declaration enables succession, civil-status changes, insurance claims and dissolution or adjustment of personal legal relationships.
