Professional negligence
Professional negligence is a breach of the care expected from a qualified professional, causing loss to a client or third party.
Professional negligence concerns lawyers, doctors, architects, auditors, engineers and other specialists whose work must meet recognised professional standards. In Switzerland, liability may be contractual, non-contractual or based on special professional duties, depending on the relationship and harm. The claimant usually must show a duty or mandate, breach of the required standard of care, causation and loss. Expert evidence is often important. The professional is not liable merely because the outcome was poor, but for falling below the applicable standard.
