Provisional dismissal of objection is a summary procedure in Swiss debt enforcement. It is available where the creditor produces a written acknowledgment of debt, such as a signed contract, loan acknowledgment or other document showing the debtor’s obligation. If granted, the objection to the payment order is lifted provisionally and enforcement may continue. The debtor can still challenge the claim by bringing an action to disprove the debt within the relevant period. The procedure is faster than ordinary litigation but does not finally decide the underlying claim.
