Qualified written form

Qualified written form adds statutory or agreed elements to ordinary writing, such as handwritten wording, special disclosures or separate signatures.

Qualified written form is stricter than simple written form. Swiss law or the parties may require additional elements beyond a written text and signature, for example handwritten statements, specific information, prominent wording, dates, separate approvals or signatures of all parties. The purpose is often to warn, protect a weaker party or ensure clarity. The exact consequence of non-compliance depends on the rule creating the requirement. Where the qualified form is a validity requirement, a document satisfying only ordinary written form will not suffice.
