Recognition of foreign judgments

Recognition gives a foreign judgment legal effect in Switzerland, subject to jurisdiction, finality and public-policy safeguards.

Recognition means that a foreign judgment is accepted as producing legal effects in Switzerland, such as res judicata, status effects or a basis for enforcement. Swiss authorities examine whether the foreign court had acceptable jurisdiction, whether the decision is sufficiently final or binding, and whether procedural fairness and Swiss public policy are respected. Treaties, especially in European relations, may simplify the process. Recognition is distinct from enforcement: a judgment may be recognised even when no coercive measures are needed.
