Reply
A reply is the claimant’s further written submission responding to the defence and refining disputed facts, legal arguments and evidence.
In Swiss civil litigation, a reply is usually the claimant’s second brief where the court orders a second exchange of written submissions. It answers the statement of defence, clarifies or supplements factual allegations within procedural limits, comments on objections and may address evidence. The reply is important because Swiss procedure restricts late new allegations and evidence. In simpler or expedited matters, the court may dispense with a full second exchange and proceed to a hearing or decision.
