Right of residence

The right of residence is a personal servitude under Swiss property law. It entitles a specified person to occupy a dwelling or defined part of a building, often for life, and is entered in the land register when created over land. Unlike a lease, it is a real right and generally binds successors in ownership. It is typically non-transferable and non-inheritable, unless the law or the agreement allows limited use by family or household members. Its scope depends on the constitutive act and land-register entry.
