Separation of property

Separation of property keeps each spouse’s assets and debts separate, with no statutory sharing of marital gains on liquidation.

Separation of property is a matrimonial property regime under Swiss family law. Each spouse owns, manages, and disposes of their own assets and is generally responsible for their own debts. Unlike participation in acquired property, there is no calculation and sharing of acquired gains when the regime is liquidated. Spouses may choose this regime by marital agreement, and it may also arise by court order or operation of law in certain situations. It does not exclude duties of mutual support, family maintenance, or consequences of divorce such as maintenance or pension division.
