Source right

A real right or servitude concerning the taking and use of water from a spring on another parcel, governed by land and water rules.

A source right concerns the capture, diversion, or use of water emerging from a spring, particularly when the spring lies on another person’s land. In Swiss law it may appear as an easement or other real entitlement entered in the land register, while public-law water and environmental rules may also matter. The right’s content depends on its creation: quantity, manner of use, access for maintenance, pipes, and duties to avoid harm to the servient land. It must be distinguished from ordinary contractual water supply arrangements.
