Standard contractual clauses

Standard contractual clauses are model data-transfer terms that impose obligations on exporters and importers of personal data. In Switzerland they are relevant when personal data is sent to a country without adequate data protection, unless another lawful safeguard applies. Swiss practice often looks to recognised clauses, including EU clauses adapted where necessary to Swiss law. Parties must still assess the actual transfer risks, implement supplementary measures where needed, and ensure the clauses reflect the roles and processing activities involved.
