Sublease
A sublease lets a tenant grant use of the rented property to a third party while remaining bound to the landlord.
Under Swiss tenancy law, a tenant may generally sublet all or part of the premises with the landlord’s consent. The landlord may refuse consent only on recognised grounds, such as missing disclosure of terms, abusive sublease conditions, or substantial disadvantages. The main lease remains in force: the tenant continues to owe rent and proper use to the landlord, while the subtenant has a separate contract with the tenant. If the main lease ends, the sublease is usually affected in practice.
